Terms and Conditions and Cancellation Policy

By placing a booking with us, La Manga Property Rentals Club, you (the lead guest) and your booking party (guests) agree to the following terms and conditions as set-out. During your stay you agree to abide by the subsequent conditions as set-out. If you have any questions about booking with us, please contact us before making a booking.

To place a booking with us, the lead guest must be at least 18 years of age. The maximum number of staying guests per room is illustrated in the room occupancy details on the website. Where the person making the booking is different to the lead guest taking up the occupation, the person making the booking may be held responsible for cancellation, non-arrival and damages as set-out within and you must take full responsibility for you and your party’s travel insurance. Only the lead guest and the named booking party are allowed to use the property and its facilities.

We will refuse access of your party to the property if you arrive with additional or different guest than recorded on your booking form. If access is denied due to the above circumstances, your booking may be cancelled, and you may be asked to leave.
Our cancellation policy will become valid and all monies paid will become non-refundable.

Reservations:

To secure any booking we require a completed booking form listing details of all guests and a non-refundable deposit of €250.

Deposit payments must be ‘cleared funds’ before a booking can be confirmed. Deposits are only refundable under the conditions set out here within.

If you are booking within 30 days of your expected date of arrival then the full rental fee will become payable. The full amount must be paid within 48hours of reservation to secure your booking. Failure to do so will result in your reservation being cancelled. A booking confirmation email will be sent when the full balance has been paid.

Payments can be made through our online booking system, bank transfer (as agreed) or a cash deposit at our office. Any charges raised against us by our banks for handling dishonoured bank transfers or any other payments, must be reimbursed by the lead guest within seven (7) days of any request to do so.

Upon receipt of a cleared deposit you will receive confirmation of your booking.

Final payment of the total rent must be received no later than 30 days prior to your arrival date if booked directly through La Manga Property Rentals Club. The remaining balance will include the remaining balance of the rent, the Cleaning Fees and any optional extras you may have added for your stay.

Failure to make the final payment on time will result in the booking being automatically cancelled without notice. If this happens, our cancellation policy will apply.

Check-in & Check-out:

Check in:

  • Your rental fee does not cover late check in fee.
  • Check in is between 16:00pm and 20:00pm and arrival outside of this time will be charged as follows: After 20.00pm and before midnight. €30
  • After midnight € 50 (upon request only)
  • 2 hours after your estimated time of arrival €20.00

Check-out by 10:00am on day of departure

On Arrival:

By local laws you will be required to supply photo ID in the form of a passport or national ID card for all adults over 16 years in your booking party.

Cancellation, Returned Deposit & Non-Arrival Conditions

Guest who need to cancel a booking should contact us as soon as possible.

Deposits already paid are only returned in accordance with the following conditions;

  • Cancellation made within 48 hours of booking = Full deposit refund
  • Cancellation made 30 days or less of arrival date = No refund issued, full amount of booking due

Non-arrival guests, who are unable to attend or fail to attend for whatever reason forfeit their deposit paid and the full amount of the booking will be due. It is suggested that booking guests take out appropriate holiday / cancellation insurance where required.

In the rare event we need to cancel your booking with us, please be aware that we cannot be held liable for circumstances beyond our control and that our liability to you is limited to the refund of any payment already made. Any agreed refunds can only be refunded direct back to the credit card or the bank account the monies were received from. We will however endeavour to find you other We will however endeavour to find you other suitable accommodation.

Changing your Booking

Should you need to change your dates for the property you have booked, you may do so subject to the following:

  • Date changes requested more than three months before your arrival will incur an administrative charge of 30€.
  • Changing your dates less than three months prior to your stay will incur an administrative charge of 60€.
  • If you shorten your stay for any reason, no part refund will be offered
  • Changing properties will incur an administration charge of 50€ providing the change is requested at least 3 months before your stay and subject to availability.
  • Changing properties less than three months prior to your stay will incur an administration charge of 100€.
  • We cannot facilitate a change of property less than one month before your stay and should a change be necessary our cancellation policy will apply. We reserve the right to refuse a date change or property change. In such circumstances our cancellation policy will apply
  • On rare occasions it may be unavoidable to change your chosen property because of circumstances beyond our or the owners control; we will endeavour to inform you of this as soon as possible and offer you either alternative accommodation of similar or superior standard, a refund if nothing is suitable or discuss other options. No further claim against the owner or the letting agent for any loss suffered will be considered.

WiFi & Appropriate Usage Policy

Where WiFi Internet access is provided, guests accept to use this access to the Internet fairly and appropriately.

The Internet access provided is intended for general use such as access to the world wide web, email, messaging, social media, light video / music / media streaming. It is not intended or ideally suited for heavy media streaming, online gaming, extensive downloads / uploads. Access to illegal activity or use of our network for illegal activity is not prohibited and will be reported to local authorities.

Noise:

All guests agree to respect the privacy and peace of all other staying guests, neighbours and the owners at all times. We reserve the right to cancel a booking with immediate effect if guests are not honouring this agreement or causing a disturbance / nuisance to other guests, neighbours or the owners.

Security Deposit:

A security deposit of €250 is required upon arrival. This can be paid either by credit/debit card or cash upon check in. If after check out, and once the property has been fully inspected, no accidental damage or breakages have been notified or detected ,the Security deposit will be refunded direct back to the credit/debit card the monies were received from or direct payment to your bank account within 14 days of departure.

Damages & Lost Property:

We reserve the right to charge the lead guest for any accidental damage caused through the course of a booking by any member of the booking party. This includes breakages, spillages, stains, damage to furniture or fixtures and fittings. The cost to repair any such damage will be deducted from the Security deposit. If however, the cost to repair the damage or to replace a damaged item is more than the security deposit held, the lead guest will be liable to pay the difference as soon as the exact value of the damages has been determined and La Manga Property Rentals Club has informed him/her in writing about the difference.

Any accidental damages should be reported as soon as possible in order to minimise damage and associated costs. Lost keys / fobs / access cards will incur a replacement charge per key / fob / card lost.

Apartment visits to fix problems caused by guests or where guests have not followed the instructions provided, for example if you lock yourself out etc., may incur a charge of €60 between the hours of 9.00am and 22.00pm increasing to €80 per visit between the hours of 22.00pm and 9.00am (for example if you lock yourself out etc.)

In the event of you losing your key or damage caused to the lock requiring it to be replaced – this will incur a call out charge that is relevant to the time of day and €100 for the lock change.

Departure:

The guest must ensure that the property is left in a presentable and tidy state including the washing of dishes, cutlery, and kitchen utensils etc.; emptying of the refrigerator, the freezer, and dust bins; cleaning the barbecue; and removing rubbish/trash. This is required even though the guest has paid a final cleaning fee or such a cleaning fee is already included in the rent. La Manga Property Rentals Club reserves the right to deduct any additional cleaning costs from their Security deposit, if the guest should not leave the property in the above-mentioned state.

Utilities:

A generous allowance of water and electricity is included in the rental price; however, you will be charged for abuse of these services (leaving water on/hoses open and running them for long periods of time, leaving doors/windows open when using air conditioning/heating, etc.). Water and electricity readings are taken before and after every stay in every property.

Air Conditioning:

Where applicable our Owners have installed an Air conditioning Metering system. This system is designed to prevent the mis-use and waste of electric , which is a very expensive commodity. The owner will provide you, the guest, with wha they feel isa suitable amount of credit for the period time for your stay . If you require further credits, these can be purchased from La Manga Property Rentals Club by contacting us at Le Club Sports Bar on Tomas Maestre Marina or by email or phone. Payment for these credits will have to be paid in cash. La Manga Property Rentals Club, accept no responsibility for the breakdown of these units under any circumstances, although we will always endeavour to rectify the matter as soon as possible.

Lost Property:

Any lost property, if discovered and found, left behind by guests during a stay will be held for a period of 14 days. While we will make our best efforts to reunite lost property with their owner we accept no responsibility in replacing lost items and encourage guests to ensure they have all their belonging before checking-out. We may offer to post lost items via recorded delivery at the cost of the property owner, otherwise collection can be arranged.

Smoking:

Holiday and Travel Insurance, including cancellation cover, is essential for your own protection and we strongly recommend that you and all members of your party be suitably insured. If you choose to travel without adequate holiday insurance, La Manga Property Rentals Club will not be liable for any injury, damage or loss of personal belongings, arising in respect of which insurance cover would otherwise have been available.

Pets:

Pets are NOT allowed in any property unless the Owner/La Manga Property Rentals Club has agreed prior to your arrival and extra fees might apply. Please ask before making a booking. Pets found at the property without prior permission could result in forfeiture of the property and your security deposit.

Parking:

Where on-site parking is provided guests accept that they park their vehicles at their own risk.

Liability:

La Manga Property Rentals Club do not accept liability for any act or neglect on the part of the owners or any other person not within their employment or their control, nor for any accident, damage, loss, injury or expense, whether to person or property, which the tenants may suffer arising out of, or in any way connected with the letting. The owner and La Manga Property Rentals Club also accepts no liability for loss of or damage to the tenants’ possessions on the owners’ property, or any other unpredictable events that La Manga Property Rentals Club could not have prevented.

Should a gross defect or fault be detected in a holiday accommodation, La Manga Property Rentals Club will normally offer the tenant an equivalent holiday accommodation of the same price level. Should the alternative holiday home be of a lower price, the price difference will be refunded.

Should it not be possible to find a satisfactory solution due to a lack of available properties or due to the non-acceptance of the alternative holiday home by the tenant, the total rent or a part of the rent will be refunded according to the degree of liability determined by Choice.

Property Standards:

We have carefully selected all the properties that we advertise and we endeavour to maintain high standards. However, if you have a problem during your holiday, immediately inform La Manga Property Rentals Club who will then endeavour to put things right. If you fail to do this, we cannot accept responsibility, as we have not had the opportunity to investigate and rectify the problem. Although we will make every effort to deal with problems promptly, a reasonable amount of time should be allowed for repairs to be completed by outside contractors.

If you find a defect, fault or damage is detected, La Manga Property Rental Club should be informed in writing by email to info@lamangapropertyrentalsclub.com within 24 hours after arrival.

Please note that La Manga Property Rentals Club, accept no liability for intermittent failure of public supplies or utilities such as water, electricity, gas or Internet over which we have no control, nor of sewage systems, plumbing or mechanical equipment in the properties, but shall use our best endeavours to arrange prompt repairs where possible.

Inevitably, items break or require maintenance, therefore please be aware that you may encounter maintenance staff during your stay. Please also remember that these are people’s homes – please leave the property in a reasonably clean and tidy condition and remove all rubbish at the end of your stay. We reserve the right to charge for extra cleaning and rubbish removal if necessary, and to deduct this from your security deposit.

Accuracy:

We endeavour to ensure that all the information on our website is accurate; however occasionally changes and errors occur and we reserve the right to correct details in such circumstances. We make every effort to make sure that descriptions, photographs of furniture and fittings etc. are accurate; however there may sometimes be changes we are unaware of, and therefore vary from our website copy and photographs. We accept no liability should a description or a photograph be inaccurate. If a particular facility offered in a property is essential to the booking of your holiday, please ensure that La Manga Property Rentals Club, are made aware of this prior to you completing the booking confirmation pages

Your Personal Details & Privacy Data Protection:

La Manga Property Rentals Club collects personal information from the Guest so as to be able to issue the necessary notices and requests for payment. We are required to keep a register of guests over the age of 16 who stay with us, this includes full names and nationality, and/or passport number. This is in accordance with the (Immigration (Hotel records) Order 1972). These records are kept for a minimum of 12 months and in accordance with the DPA (Data Protection Act 1998) and the GDPR (General Data Protection Regulation).

La Manga property Rentals Club processes data in accordance with the Data Protection Act 2001 and takes all reasonable measures to ensure the safeguard of such data, to avoid data misuse and to limit the accessibility of persons to such data only on a need-to-know basis only.

Our policy surrounding the personal details you provide as part of any booking or enquiry through this website/or third-party website, including the privacy of those details are explained and set out in our Privacy Policy.

Governing Law and Jurisdiction– We operate within Spain and we are subject to the Laws of Spain, and all disputes are subject to the non-exclusive jurisdiction of the Courts of Justice of Spain.

Complaint Procedures

If you are unhappy with the cleanliness of the property or if you detect any damage to or defects of the property, you should submit a complaint immediately. Complaints should be made in writing to La Manga Property Rentals Club via email to info@lamangapropertyrentalsclub.com.

All complaints will be reviewed and investigated by La Manga Property Rentals Club no later than 14 days after the end of the rental contract.

Our Right To Cancellation

We reserve the right to cancel any booking without compensation, refund or reimbursement if the terms of these conditions are breached.

Validity

The stated terms and conditions are valid for rental agreements made between the tenant and the homeowner through La Manga Property rentals Club who acts as an agent/intermediary. The conditions and the quoted prices stated on this website are valid, excluding misprints, from February,2020.
